Welcome to Brightwood Horizon Landscape. These Terms & Conditions govern your use of our website and your purchase or use of our landscaping services. By using our website, requesting an estimate, approving a proposal, or engaging Brightwood Horizon Landscape for services, you agree to these Terms & Conditions.
01 — Services
Brightwood Horizon Landscape provides landscaping, landscape maintenance, planting, hardscaping, outdoor improvements, and related services as described in the applicable proposal or service agreement.
The specific scope of work, materials, pricing, schedule, warranties, and other project details will be established in the written proposal, estimate, work order, or service agreement provided for each project.
Services not specifically included in the agreed scope are not included in the project price.
02 — Estimates & Pricing
Estimates and proposals are generally valid for 30 days unless otherwise stated.
Pricing is based on the information and site conditions reasonably observable at the time of estimating. Final pricing may change if material costs, availability, labor requirements, site conditions, or the requested scope of work changes.
Additional work or materials outside the original scope may require a written change order and additional charges.
03 — Changes to the Project
Customers may request changes or additional work after a proposal has been approved.
Changes to the scope of work may affect the project's price and completion schedule. Brightwood Horizon Landscape will make reasonable efforts to communicate additional costs before performing non-emergency additional work.
04 — Site Access & Customer Responsibilities
Customers are responsible for providing safe and reasonable access to the property and work areas.
Customers should:

Provide access to gates and designated work areas.

Secure pets during scheduled work.

Remove personal belongings and other items from work areas.

Inform Brightwood Horizon Landscape of known underground utilities, irrigation lines, septic systems, drainage systems, electrical lines, or other concealed property features.

Obtain any required HOA or property-owner approvals unless otherwise agreed in writing.
Delays or additional costs caused by lack of access, unsafe conditions, pets, customer property, or circumstances outside our reasonable control may result in additional charges or rescheduling.
05 — Existing & Unforeseen Conditions
Landscaping and construction work may uncover conditions that could not reasonably be identified before work begins.
These may include rock, buried concrete, roots, unsuitable soil, drainage issues, existing utility lines, old irrigation systems, or other concealed conditions.
When these conditions require additional labor, materials, equipment, or professional services, additional charges may apply.
We will make reasonable efforts to notify the Customer when such conditions are discovered.
06 — Underground Utilities
Customers are responsible for identifying and disclosing known private underground utilities and property systems.
Public utility locating services may not identify privately installed systems such as private irrigation lines, landscape lighting, invisible fences, private drainage, septic systems, or other customer-installed utilities.
Brightwood Horizon Landscape is not responsible for damage to undisclosed private utilities or concealed systems that could not reasonably have been identified before work began.
07 — Irrigation & Licensed Professionals
Brightwood Horizon Landscape does not sell, design, or personally perform regulated landscape irrigation work.
When irrigation services are required as part of a landscape project, Brightwood Horizon Landscape acts solely as a project coordinator or referral agent. All regulated irrigation design, installation, alteration, or repair will be handled by an independent, qualified professional holding an active Texas Landscape Irrigator license in accordance with Texas Commission on Environmental Quality (TCEQ) regulations.
All contracts, permitting, and billing for irrigation work are handled directly by the applicable licensed professional. The Independent licensed professional is solely responsible for providing their specific credentials 'LI' license number, and required state disclosures directly to the Client on their own separate project documentation and billing.
08 — Chemical Applications & Weed Control
Brightwood Horizon Landscape does not provide commercial pesticide, herbicide, or chemical weed control applications. To ensure full compliance with Texas Department of Agriculture (TDA) regulations, our weed management services are strictly limited to mechanical, manual, and cultural methods.
These permitted services include hand-weeding, mechanical weed cutting, weed-shaving, soil cultivation, professional mowing heights, and the installation of physical barriers such as landscape fabric and mulch.
We do not advertise, bid on, quote, or perform chemical weed spraying, pre-emergent chemical applications, or "weed-and-feed" chemical fertilizer treatments. Brightwood Horizon Landscape will not apply over-the-counter or organic chemical weed killers on the Customer’s property, regardless of whether the product is supplied by the Customer or a third party. For targeted chemical eradication of weeds or pests, the Customer must engage an independent, TDA-licensed commercial applicator.
09 — Subcontractors
Brightwood Horizon Landscape may use qualified subcontractors, suppliers, tradespeople, and specialty professionals when necessary to complete a project.
Depending on the project, these professionals may include irrigation contractors, electricians, plumbers, concrete contractors, drainage specialists, arborists, fencing contractors, or other qualified professionals.
Any services requiring specialized licensing will be performed by the appropriately qualified professional.
10 — Scheduling & Weather
Project schedules are estimates unless a specific completion date is agreed to in writing.
Weather, storms, extreme temperatures, material shortages, supplier delays, permitting, inspections, subcontractor availability, site conditions, and other circumstances outside our reasonable control may affect scheduling.
We will make reasonable efforts to keep customers informed of significant delays and reschedule work as soon as reasonably possible.
11 — Payments
Payment terms, deposits, progress payments, and final payment requirements will be stated in the applicable proposal, invoice, or service agreement.
Customers are responsible for paying all undisputed amounts according to the agreed payment schedule.
Brightwood Horizon Landscape may suspend work or services when an account becomes past due.
12 — Cancellation & Rescheduling
Customers should provide reasonable notice when requesting cancellation or rescheduling.
Customers may be responsible for reasonable costs already incurred for labor, materials, special-order products, subcontractors, delivery, mobilization, or other project-specific expenses.
Additional cancellation or rescheduling terms may be included in the applicable project agreement.
13 — Plants, Sod & Living Materials
Plants, trees, shrubs, sod, seed, grass, and other living materials are affected by weather, watering, soil conditions, pests, disease, sunlight, drainage, maintenance, and other environmental factors.
Unless a written warranty specifically states otherwise, Brightwood Horizon Landscape does not guarantee the survival of living materials.
Any applicable plant or workmanship warranty will be governed by the terms provided in the applicable proposal or service agreement.
14 — Workmanship & Warranties
Any workmanship or product warranty offered by Brightwood Horizon Landscape will be stated in the applicable proposal or service agreement.
Warranty coverage may not apply to damage or failure resulting from misuse, neglect, lack of maintenance, weather, pests, disease, unauthorized alterations, third-party work, existing conditions, soil movement, drainage issues, or circumstances outside our reasonable control.
Customers must provide reasonable access for inspection and warranty-related service.
15 — Property & Existing Conditions
We will use reasonable care while performing our services.
Landscaping and construction work may involve vehicles, equipment, excavation, material delivery, foot traffic, and other activities that can affect soil, turf, driveways, walkways, fences, or other areas of the property.
Existing damage or concealed conditions may be documented before work begins.
Brightwood Horizon Landscape is not responsible for pre-existing conditions or damage caused by concealed conditions that could not reasonably have been identified before work.
16 — Cleanup
We will perform reasonable cleanup associated with the agreed scope of work.
Unless specifically included in the proposal, restoration or replacement of areas outside the agreed work area is not included.
17 — Photos & Project Documentation
Brightwood Horizon Landscape may photograph or record project areas for project documentation, quality control, warranty records, and internal business purposes.
We may request separate permission before using identifiable project photographs for marketing or promotional purposes.
18 — Website Information
We make reasonable efforts to keep the information on this website accurate and current. However, website information is provided for general informational purposes and does not constitute a project-specific proposal, estimate, guarantee, or professional advice.
Project-specific services and pricing are governed by the applicable written proposal or service agreement.
19 — Limitation of Liability
To the maximum extent permitted by applicable law, Brightwood Horizon Landscape will not be responsible for indirect, incidental, special, or consequential damages arising from the use of our website or services.
Nothing in these Terms is intended to waive or limit any liability that cannot legally be waived or limited under Texas law.
20— Right to Refuse or Suspend Service
Brightwood Horizon Landscape reserves the right to decline or suspend services when conditions are unsafe, access is unavailable, required approvals or permits are not obtained, payments are past due, or continuing the work would create an unreasonable risk to people, property, or compliance with applicable requirements.
21 — Governing Law
These Terms & Conditions are governed by the laws of the State of Texas.
22 — Changes to These Terms
Brightwood Horizon Landscape may update these Terms & Conditions from time to time. The current version will be posted on this website with the applicable effective date.
Changes to these website Terms do not modify an existing signed project agreement unless otherwise agreed in writing.
